Virtual Reception User Agreement

(Last Updated 12/05/2021)

You have selected to add the Virtual Reception (“V-Reception”) feature to your account as to be provided to you by TouchHealth, Inc. (“TouchHealth”). The plan may or may not include a free trial for first time users (“Trial Users”). For Trial Users, unless you remove this service from your plan, your billing will begin on the day following the trial period. You will be responsbile for payment from that day for a prorated amount for the remaining part of the calendar month (based on a 30-day month).

You acknowledge that you are either the owner of this TouchHealth account or that you are an authorized user of this account and allowed to make modifications to services and features on the account.

Important: This service is not intended for use where the sms notification provided by this service is critical to a health need or where financial, physical or psychological harm could result from an untimely delivery OR FAILURE OF DELIVERY of the SMS notification.

Your monthly billing cycle begins on the first day of each calendar month. For all users, you are billed in arrears for the previous billing cycle. If you enabled the service in the middle of the month, that month will be prorated (based on a 30 day month) and billed on 1st day of the next calendar month (next billing cycle). If you add a user during the monthly billing cycle that exceeds the number of users included in your plan, then you will be charged a prorated amount for that user (from that day to 1st day of the next calendar month) on your next billing cycle, i.e. this will be billed in arrears. If you have a number of users in excess of the number included in your current plan, and you remove a user during your billing cycle, that user will be removed since the day you turn them off and you will be charged a prorated amount for that user (from 1st day of the month to that day). Thus, if you add a user that causes your total number of users to exceed the number included in your current plan, you are committed to paying for that user (in a prorated amount) until the end of that monthly billing cycle and further.

If you change from one plan to another in the middle of a billing cycle, then the change will be reflected from that day . You will be charged a prorated price according to days you actually used the plans.

(All prorating is based on a 30-day month, regardless of actual days in the month)

TouchHealth SMS notifications used in the Virtual Reception feature rely on third party SMS services. TouchHealth does not warranty the quality or timeliness of the delivery of these messages and you agree that TouchHealth is not liable for any damages that may occur as a result of message not being delivered or that is not delivered in a timely fashion.

The third-party SMS services used by TouchHealth tend to deliver 99% of deliverable messages within 20 seconds of submission, however, messages can occasionally be delayed due to carrier traffic or other unforeseen technical reasons. TouchHealth makes no warranty on the timely delivery of these messages and provides SMS notifications as a best effort service. If your notices are regularly delayed, please notify TouchHealth and we will contact the carrier to uncover and fix the issue. Any account may cancel at any time due to quality of service issues and TouchHealth will be happy to refund the previous month’s charges.

Certain cell phone plans are unable to receive ‘short code’ text messages, the type used by TouchHealth for SMS communications. While ‘short code’ messages are more reliable than other types of SMS messages, various cell phone plans and carriers are not enabled to receive short code messages. This occasionally, but not exclusively, includes highly discounted prepaid mobile phone services. Additionally, some users have disabled short code reception on their own personal accounts.

Once you agree to the terms and your payment information has been confirmed, you will see a new link above called “V-Reception” under Settings in your TouchHealth account. Go there to add and remove users. You can also learn more about how to use this powerful feature in your waiting room.
